COURT ACTION RADZIWI??

John Radziwi??, the son of prince Stanis?aw Radziwi?? has filed a lawsuit in the District Court in Warsaw against the Polish Province of the Marian Fathers for breach of trust. In the lawsuit, he contends that the Marian Fathers have betrayed the will of prince Stanis?aw Radziwi??, the founder of the Church of the Blessed Virgin Mary and St Ann at Fawley Court, through the deconsecration of the church and are forcing him to remove the remains of his father from the crypt in which herests.

The prince’s son is outraged by the decision of Marian Fathers to deconsecrate the Church and by their intention to sell Fawley Court together with the Church, in the crypt of which rests the late prince Stanis?aw Radziwi?? and the urn with the ashes of his stepbrother, Anthony Radziwi??. He has filed the lawsuit in a polish court because the Marian Fathers in Great Britain are part of the Polish Province of the Congregation.

In the lawsuit John Radziwi?? requests:
1.declare that the sale of the Fawley Court, Henley-on-Thames (UK) constitutes a breach of the fiduciary obligations of the Congregation of Marian Fathers with a seat in Poland, Warsaw under a trust created by prince Stanislas Albert Radziwi??, which encompasses the Church of St. Mary and St. Ann in Fawley Court, the content of which is the obligation to manage the Church for the benefit of the incoming believers of Catholic faith, and a breach of the fiduciary obligations of the Marian Fathers Charitable Trust Incorporated with its seat in UK under a constructive trust encompassing the above mentioned Church, of an analogical content, or alternatively:
- declare that the sale of the Fawley Court, Henley-on-Thames (UK) constitutes a donatio cum modo (a gift with an order) obliging the defendants to manage the Church of St. Mary and St. Ann in Fawley Court for the benefit of the incoming believers of Catholic faith;
2. order the defendants to refrain from any action with respect to Fawley Court, Hedley-on-Thames, Oxfordshire RG9 3AE w Wlk. Brytanii aiming at offering for sale, selling or completing the sale of the said property;
3. order the defendants to refrain from violating the personal rights of the claimant, based on the cult of the deceased relatives;


- to secure the claim by restraining the defendants for the time of the proceedings from taking any action aiming at offering for sale, selling or completing the sale of the property at Fawley Court, Henley-on-Thames, Oxfordshire RG9 3AE in UK.
